TERMS & CONDITIONS
All race participants must be 18 years or older (as of the original closing date of the competition) to participate as an adult. All participants must hold a valid go-kart racing license issued by K1 Speed. Any and all participants and racers must comply with all safety regulations and track rules.
Teen participants must have parental or legal guardian consent to participate. All teen participants must also hold a valid go-kart racing license issued by K1 Speed. Teen participants must comply with age-appropriate safety guidelines.
DISCLAIMER
Please read this entrance form carefully. You will be waiving important legal rights as a condition of participating in the competition.
All racers agree that they voluntarily waive all recreational liability and assume all risks of Go-Kart racing. All racers acknowledge that they recognize that Go-Kart racing is potentially dangerous and all participants, including any teens or adults participating in the Teen/Adult Championships, are entering into this competition and racing Go-Karts at their own risk. Any persons racing under the age of 18 have the full permission and consent of any legal guardian or parent and such person acknowledges and recognizes that Go-Kart racing is potentially dangerous and there is a serious risk of severe injury, disfigurement, and death. All racers, including any and all potential track persons, have signed K1 Speed’s required “Express Assumption of Risk, Complete Waiver and Agreement not to Sue, and Indemnity Agreement.” (“the Waiver”) The terms of the Waiver are incorporated herein.
Specific causes of harm include collisions, debris, mechanical failures, track conditions, and the other potential scenarios that are set forth in the Waiver and are incorporated here by this reference.
RELEASE AND INDEMNITY
All racers shall release and indemnify any and all race organizers, including their agents, employees, owners, assigns, and any and all promoters or advertisers, from any and all liability for death, personal injury, and property damage. This release shall include but not be limited to all conduct and activities relating to the competition and go-kart race, including any advertising, promotion, marketing, and prize distribution. The release and indemnity shall be interpreted in the broadest terms and shall include every aspect of the sport and race, including any and all officials practice, demonstrations, and competition.
PARTICIPANT/RACER ACKNOWLEDGMENT
All racers hereby agree and acknowledge that they are aware of all disclaimers and rights, and they voluntarily waive these rights, and acknowledge the Waiver. All racers also agree and acknowledge that they are aware and understand any and all race and competition rules and agree to be bound by these rules. All racers also acknowledge and agree that they have disclosed any and all medical conditions that may affect or impair their ability to participate safely in the competition. All racers also agree and acknowledge that they are not under the influence of any alcoholic beverages or controlled or uncontrolled substances and further acknowledge and agree that if they are discovered to be under any influence of any alcohol or drugs they shall be immediately disqualified from the competition.
GUIDELINES OF THE CHAMPIONSHIP SERIES AND PRIZE DISTRIBUTION
Racers who participate in K1 Speed Bounty will compete in a first come first serve race challenge in which all participants will try to break a pre-determined lap time. The first person to break the lap time during the hours of the event will present their timing sheet to the Bounty Booth for verification. Once the racer’s lap time is verified, they will be rewarded the $500 prize and the bounty event will close. In the event that the bounty time is not broken during the duration of the event, the bounty event will close and the prize will roll over to be added to the reward for the next bounty event.
Prize proceeds shall be paid by either electronic transfer, check, or another other designated method. Winners must provide accurate payment details to receive their prizes promptly. For any race participants under 18 years old, parental, or legal guardian consent is required to participate in the competition and receive any prizes. Parents and/or legal guardians are responsible for overseeing any minor child’s participation, ensuring compliance with these terms, and handling any prize-related matters. Prizes shall be distributed to parents and legal guardians. Winners are responsible for any taxes or fees associated with their prize proceeds. The event organizers will provide necessary documentation for tax reporting purposes if so required.
PERFORMANCE, ADVERTISING AND PROMOTIONAL RELEASE
All racers grant the event organizers, sponsors, and their affiliates the right to capture, record, and use your race performance during the Event. This includes but is not limited to any and all race footage, interviews, photographs, and audio recordings. All racers authorize the use of their name, likeness, voice, and biographical information for promotional purposes related to the Event, both during and after the competition. All racers agree and acknowledge that any and all race performance or participation may be broadcasted, streamed, or published on various media platforms, including television, social media, and official event channels. All racers consent to the use of their name, image, and performance/race related content in advertising, marketing, and promotional materials associated with the Event.
This release extends to promotional campaigns, posters, flyers, press releases, websites, and any other media used to promote the Event. All racers agree and acknowledge that the Event organizers have the right to edit, modify, or adapt your content for promotional purposes.
WAIVER AND INDEMNIFICATION
All racers agree and acknowledge that they waive any and all claims, demands, or causes of action against the Event organizers, sponsors, and their representatives arising from the use of their performance, name, or likeness.
All racers agree and acknowledge they release the Event organizers from any liability related to the use of any race content that includes them for promotional purposes.
All racers agree and acknowledge that they indemnify and hold harmless the Event organizers from any third-party claims resulting from the use of your performance or promotional materials.
DISPUTE RESOLUTION
Any disputes arising from these terms and conditions shall be resolved through binding arbitration. The arbitration process will be conducted in accordance with the laws of the State of California and the Venue shall be California. The decision of the arbitrator shall be final and binding. The rules shall be set forth by American Arbitration Association Commercial Arbitration Rules.
In the event of any legal action related to these terms and conditions, the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs incurred during the dispute.
ACKNOWLEDGEMENT
All racers agree and acknowledge that they have read and understood this release.
All racers agree and acknowledge they voluntarily participate in this Event and are fully aware and understand any and all legal rights contained in this agreement.
